Kolkata: BHARATI Tamang has moved the Calcutta High Court challenging the lower court’s ruling on discharging Gorkha Janmukti Morcha president Bimal Gurung from her husband Madan Tamang’s assassination case.

On Bharati’s behalf, advocate Jay Sengupta moved the challenge petition in the court of justice Debi Prosad Dey. The court has admitted the petition for hearing on 11 December.

Madan Tamang, the then president of All India Gorkha League, was hacked to death in broad day in Darjeeling town in 2010. CBI subsequently took over the investigation and had filed charge-sheet against 48 accused, including Gurung, earlier this year.

But on 17 August, judge Kundan Kumar Kumai of the City Sessions Court in Kolkata, discharged Gurung from the case saying that there was no evidence that indicates his involvement in the assassination. [READ: Court discharges Bimal Gurung from Madan Tamang assassination case]
